Securing your assets in the face of crises: realities and strategies

In a fragile economic and geopolitical context, one question keeps recurring among wealthy families: "Is my wealth truly safe?" Between fears of dispossession and legal realities, it's important to distinguish between wishful thinking and the actual protection of assets. Far from being alarmist, securing wealth relies on understanding legal mechanisms—such as the Sapin 2 law or the BRRD (Bank Recovery and Resolution Directive)—and on rigorous geographical and legal structuring.

The aim of this analysis is to provide you with a clear view of the protection mechanisms and to present the levers, particularly those in Luxembourg and the diversification of institutions, to protect your assets.

Freezing is not seizing: the fundamental legal distinction

First, we need to clarify the definitions. For a savvy investor, semantic precision is the first step in risk management. Confusing "freezing" and "seizure" leads to hasty decisions.

● Seizure: This represents a definitive dispossession. In France, it is strictly regulated and limited to the recovery of specific debts (tax or civil). The Public Treasury can, for example, use a specific administrative seizure in the case of unpaid taxes or fines. It cannot be applied systematically to all citizens.

● Freezing: This is a temporary restriction on access to liquidity. It is a safeguard measure, provided for by the Sapin 2 law, intended to maintain the stability of the overall financial system by preventing a bank run.

Sapin 2 Law and BRRD Directive: who pays in the event of a crisis?

The regulatory framework has changed significantly. Let's take a look at it.

Protective shields: FGDR and diversification

The security of your assets relies first and foremost on institutional guarantees.

● The FGDR (Deposit Guarantee and Resolution Fund) : it guarantees your deposits (current accounts, fixed-term accounts, bank savings accounts up to €100,000 per person and per establishment banking (pay attention to this concept as it is €100,000 per group, for example: BNP and Bforbank count as one institution because they are part of the same group).

● State guarantee Products such as the Livret A or the LDDS benefit from a full state guarantee, independent of the €100,000 limit.

The Sapin 2 law: a temporary lock-in

Adopted in 2016, it allows the High Council for Financial Stability (HCSF), an independent authority that brings together the main players in French financial stability, to temporarily limit redemptions on life insurance contracts. This measure can only be taken in the event of exceptional circumstances. Furthermore, it is strictly limited 3 months, renewable once.

This is not a confiscation, but a crisis management tool in the event of an insurer's insolvency. Other investments in your financial assets, such as current accounts, savings accounts (Livret A, LDDS), Equity Savings Plans (PEA), or securities accounts, are not affected by this specific measure.

There is also a Personal insurance guarantee fund (FGAP) which provides for a Guaranteed up to €70,000 per insured person and per insurance company.

The BRRD Directive and the hierarchy of creditors

Following the 2008 financial crisis, this directive was established to create a harmonized framework across the European Union to prevent bank failures. One of its main objectives is to limit costs for taxpayers.

In the event of a bank failure, the BRRD directive stipulates that internal bailouts must precede any state aid. It has therefore established a precise order for absorbing losses. Individual depositors are thus the best protected.

  1. Shareholders (total loss first)
  2. Subordinate creditors,
  3. Senior creditors,
  4. Depositorsonly for the excess portion 100 000 €.

Heritage organization: an essential bulwark to reduce
the risks

Given the existence of these risks, it is advisable to apply some rules of good financial management and to organize one's assets intelligently.

Firstly, a simple and accessible strategy is to diversify one's assets. Indeed, banking diversification allows large fortunes to be distributed between several distinct banking groups and thus multiply institutional protection.

Luxembourg life insurance: the ultimate defense

For clients with an initial capital of €250,000, Luxembourg offers a unique protection framework in Europe, often described as a "safe haven for savings".

The safety triangle

This mechanism mandates a strict separation between client assets, the insurance company's equity, and the custodian bank (approved by the Insurance Commission). In the event of the insurer's bankruptcy, your assets cannot be seized by its creditors.

The Super-Privilege

Holders of a Luxembourg contract have priority as a first-order creditor. You have priority over all other creditors, including the State, to recover your assets. This is a significantly stronger guarantee of recovery than the French system.

Conclusion: anticipation is the best form of protection.

The issue of the security of financial assets should not be addressed emotionally, but with expertise. While the state has regulatory tools at its disposal, property rights remain a fundamental and protected pillar. The real threat is not arbitrary seizure, but a lack of diversification and foresight.
